Your continued use of the website following any changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Republic of Ghana, including but not limited to the Electronic Transactions Act, 2008 (Act 772), the Data Protection Act, 2012 (Act 843), and the Sale of Goods Act, 1962 (Act 137).

2. Definitions

Throughout these Terms, the following definitions shall apply:

• “Customer” or “You”: Any individual or entity that accesses, browses, or transacts on snookerexpress.com.
• “Products”: All physical goods, merchandise, equipment, accessories, and apparel listed for sale on our shop, including snooker cues, chalk, gloves, cue cases, table accessories, and branded merchandise.
• “Order”: A confirmed request by you to purchase one or more Products through our online shop.
• “Supplier”: Third-party manufacturers and fulfilment partners, including but not limited to international suppliers, who ship Products directly to you on our behalf.
• “Platform”: The snookerexpress.com website, including all pages, subdomains, and associated digital services.

3. Eligibility

To use our Platform and place Orders, you must be at least eighteen (18) years of age or the legal age of majority in your jurisdiction, whichever is greater. By placing an Order, you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into a binding agreement, and that all information you provide to us is truthful, accurate, and complete.

4. Products and Descriptions

4.1 Product Information

We make every reasonable effort to display our Products accurately, including descriptions, images, specifications, and pricing. However, due to the nature of e-commerce and our fulfilment model, we do not guarantee that Product descriptions, photographs, colours, or other content on the Platform are entirely error-free, complete, or current. Slight variations in colour, size, or appearance may occur due to differences in device displays, manufacturing batches, or photography.

4.2 Product Availability

All Products are subject to availability. We reserve the right to discontinue any Product at any time without prior notice. If a Product you have ordered becomes unavailable, we will notify you promptly and offer either a full refund or a suitable alternative at your discretion.

5.1 Placing an Order

When you place an Order through our Platform, it constitutes an offer to purchase the selected Products. All Orders are subject to our acceptance. We reserve the right to refuse or cancel any Order for any reason, including but not limited to Product unavailability, pricing errors, suspected fraud, or violation of these Terms. You will be notified if your Order is cancelled, and any payment collected will be refunded in full.

5.2 Pricing

All prices displayed on our Platform are quoted in Ghana Cedis (GHS) unless otherwise stated. Prices are inclusive of applicable taxes but may not include shipping and handling charges, which will be calculated and displayed at checkout. We reserve the right to change prices at any time without prior notice; however, price changes will not affect Orders that have already been confirmed.

5.3 Payment Methods

We accept payment through the following methods:

• Mobile Money (MTN, Vodafone Cash, AirtelTigo Money)
• Visa and Mastercard debit/credit cards
• Bank transfers
• Other payment channels as may be made available through our payment partners (including Paystack and Hubtel)

All payments are processed through secure, PCI-compliant third-party payment gateways. Snooker Express does not directly store your full payment card details on our servers.

5.4 Order Confirmation

Upon successful payment, you will receive an Order confirmation via email and/or SMS. This confirmation serves as acknowledgment of your Order and does not constitute a contract of sale until the Products are dispatched by our Supplier.

6. Shipping and Delivery

6.1 Delivery Timeframes

As our Products are shipped from international Supplier warehouses, delivery times vary based on the destination, Supplier location, and prevailing logistics conditions. Typical delivery timeframes are as follows:

• Standard Delivery to Ghana: 15 to 45 business days
• Express Delivery (where available): 7 to 15 business days
• International Delivery (outside Ghana): subject to destination country logistics

These timeframes are estimates only and do not constitute guaranteed delivery dates. Snooker Express shall not be liable for delays caused by customs clearance, courier services, force majeure events, or circumstances beyond our reasonable control.

6.2 Shipping Costs

Shipping costs are calculated based on the weight, dimensions, and destination of your Order. The applicable shipping fee will be displayed clearly at checkout before you confirm your Order. We may offer free shipping promotions from time to time, subject to minimum order values or specific Product categories.

6.3 Customs and Import Duties

For deliveries to Ghana and other international destinations, your Order may be subject to customs duties, import taxes, and additional fees imposed by the destination country’s authorities. These charges are the sole responsibility of the Customer and are not included in the Product price or shipping fee. Snooker Express has no control over these charges and cannot predict their amount.

6.4 Tracking

Where available, we will provide you with a tracking number and link so you can monitor the progress of your shipment. Please allow 2 to 5 business days after dispatch for tracking information to become active in the courier’s system.

6.5 Risk of Loss

The risk of loss or damage to Products passes to you upon delivery to the address you provided at checkout, or upon handover to the designated courier at your location.

7. Returns, Refunds, and Exchanges

7.1 Return Policy

We want you to be satisfied with every purchase. You may request a return within fourteen (14) days of receiving your Order, provided that:

• The Product is unused, unworn, and in its original packaging with all tags and labels intact.
• The Product is not a hygiene-sensitive item (e.g., gloves, chalk) that has been opened or used.
• You provide proof of purchase (order number, receipt, or confirmation email).

7.2 Return Process

To initiate a return, contact our support team at hello@snookerexpress.com with your order number, the item(s) you wish to return, and the reason for the return. Our team will review your request within 3 business days and provide return instructions if approved.

7.3 Refunds

Approved refunds will be processed within 7 to 14 business days after we confirm receipt and inspection of the returned Product. Refunds will be issued to the original payment method. Shipping costs are non-refundable unless the return is due to our error (e.g., wrong or defective Product).

7.4 Defective or Damaged Products

If you receive a Product that is defective, damaged, or materially different from what was described on our Platform, please contact us within seven (7) days of delivery with photographic evidence. We will arrange a replacement or full refund at no additional cost to you, including return shipping.

7.5 Non-Returnable Items

The following items cannot be returned: personalised or custom-made Products, items marked as “Final Sale” or “Non-Returnable” at the time of purchase, and Products damaged due to Customer misuse, negligence, or normal wear and tear.

8. Intellectual Property

All content on the Snooker Express Platform, including but not limited to the brand name, logo, tagline (“Connect. Bond. Play.”), website design, graphics, product photography, text, software, and digital assets, is the exclusive intellectual property of Snooker Express and its parent company, Loop 33 Studios, or our licensors. This content is protected by the laws of Ghana and applicable international intellectual property conventions.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our Platform without our prior written consent. Unauthorized use of our intellectual property may result in legal action.

9. User Accounts

Certain features of our Platform may require you to create a user account. You are responsible for maintaining the confidentiality of your account credentials, for all activities that occur under your account, and for promptly notifying us of any unauthorized access. You agree not to share your account with any third party. We reserve the right to suspend or terminate any account that we believe has been compromised or is being used in violation of these Terms.

10. Prohibited Conduct

You agree not to engage in any of the following when using our Platform:

• Using the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Submitting false, misleading, or fraudulent information, including in connection with Orders or account registration.
• Attempting to interfere with, compromise, or disrupt the Platform’s systems, servers, or network security.
• Engaging in automated data collection (scraping, crawling, harvesting) without our express written permission.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Uploading or transmitting viruses, malware, or any other harmful code or material.
• Using the Platform to send unsolicited advertising, promotional materials, or spam.

11. Limitation of Liability

To the maximum extent permitted by the laws of Ghana, Snooker Express, its directors, officers, employees, agents, and Suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or the purchase of any Products, including but not limited to loss of profits, data, goodwill, or business opportunity.

Our total aggregate liability for any claim arising from or related to these Terms or your use of the Platform shall not exceed the total amount you paid to Snooker Express for the specific Order giving rise to the claim.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of Ghana.

12. Indemnification

You agree to indemnify, defend, and hold harmless Snooker Express, Loop 33 Studios, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your use of the Platform, your violation of any law or regulation, or your infringement of any third-party rights.

13. Dispute Resolution

13.1 Informal Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or any transaction on our Platform, you agree to first attempt to resolve the matter informally by contacting us at hello@snookerexpress.com. We will endeavour to resolve your concern within fourteen (14) business days.

13.2 Mediation and Arbitration

If informal resolution is unsuccessful, the parties agree to submit the dispute to mediation under the rules of the Ghana Alternative Dispute Resolution Centre. If mediation fails to resolve the dispute within thirty (30) days, either party may refer the matter to binding arbitration in Accra, Ghana, conducted in the English language.

13.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. The courts of Ghana shall have exclusive jurisdiction over any legal proceedings arising out of or related to these Terms.

14. Force Majeure

Snooker Express shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, war, terrorism, government sanctions, embargoes, strikes, supply chain disruptions, power outages, internet outages, or acts of God.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Snooker Express with respect to your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
